GDPR stands for General Data Protection Regulation and was created in the European Union (EU) to protect the personal data of its citizens. In this document we will give a practical approach for GDPR, for the actual GDPR documentation please visit: EU GDPR regulations.

Protection of personal data

‘Personal data’ means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

Examples

E.g. monitoring data such as what they’ve been looking at, what they’ve purchased etc.

Right to be forgotten

The right to be forgotten describes that every individual can request that all its personal data is removed from a system, except for legal reasons not to.

Right to restriction of processing

You still keep the data, but mark it as “restricted” and don’t touch it without further consent by the user.

Other Rights

  • The right to data portability (the ability to export one’s data in a machine-readable format).
  • The right to rectification (the ability to get personal data fixed).
  • The right to be informed (getting human-readable information, rather than long terms and conditions).
  • The right of access (the user should be able to see all the data you have about them).

Basic principles

  • Data minimization (one should not collect more data than necessary).
  • Integrity and confidentiality (all security measures to protect data that you can think of _ measures to guarantee the data has not been inappropriately modified).

Best practices

Sources for these best practices come from GDPR practical guide developers and by using the EU GDPR checklist.

Forget Me

An new industry standard is the creation of a “forget me” method that takes a userId and deletes all personal data about the user (only in case data is collected on the basis of consent or legitimate interest of the controller, NOT due to contract enforcement or legal obligation).
